‘We have not withdrawn suit against FDA’ – Tobinco

Embattled pharmaceutical company , Tobinco Pharmaceuticals says, it has not withdrawn the court against the Food and Drugs Authority(FDA)

It was rife in some sections of the media yesterday that Tobinco has decided to withdraw its suit against the FDA for an out of court settlement.

But counsel for Tobinco Pharmaceuticals, Frederick Asamoah told Accra based MONTIE FM on Thursday that the company is still in court seeking redress.

‘’It is true that we have filed a suit against the FDA, but it is not true that we have withdrawn it. Next week Wednesday, the court will hear the injunction application’’, he said.

Tobinco is seeking an injunction to stop the FDA from blacklisting and destroying its products.

It will recalled that FDA seized consignments of drugs and condoms imported by Tobinco after labeling them unregistered and fake.

The FDA on its part, says stated that the suit would not stop it from carrying out its mandate.

According to the FDA, it would continue with its mandate “by ensuring public health and safety” because these medicines can cause an individual to lose his or her life.
