Sammy Crabbe’s suit against NPP suffers hold up

An Accra Human rights court hearing the suit brought against the opposition New Patriotic Party by its suspended second vice chairman Sammy Crabbe has put the matter on hold following misunderstanding over filing procedures.

Lawyers for the NPP led by Godfred Dame Wednesday argued that the applicant failed to comply with ACT 55 of the filing rules of the court, a position the trial judge Justice Dennis Adjei agreed with.

The Judge has therefore asked Mr. Crabbe and his legal team to “put their house in order” and come back to the court.

Mr. Crabbe is praying the court to quash the decision by the NPP to suspend him.

“Since there is no written notice for the Applicant’s removal from office, in consonance with Article 10 (4) of the NPP Constitution, the Disciplinary Committee lacked jurisdiction to have recommended the Applicant’s suspension and the National Executive Committee had no jurisdiction to have affirmed the said decision to suspend the Applicant let alone indefinitely.

“It is respectfully submitted therefore My Lord, that on the basis of the grounds argued above, of Lack of, or Excess of Jurisdiction, Procedural Irregularity and breach of the rules of natural justice it is submitted that the decision of the National Disciplinary Committee dated 2nd December, 2015 and endorsed by the National Executive Committee on 10th December 2015 be brought up to this court for purposes of having same quashed,” portions of his writ to the court stated.
