Kuffour in Court over debts

Kumasi, June 11, GNA- A Kumasi Circuit court, has set July 18, for the definite hearing of a writ filed by James Antwi Engineering Company limited against one David Kuffour.

The company is demanding the recovery of an amount of 38.2 million cedis as claims for debts owed by the defendant. The plaintiff has also called for an interest on the amount to be based on the current bank rate.

A statement of claim attached to the writ and filed on behalf of the Plaintiff by Messrs Atta Opoku Legal Consults, at the court presided over by Mr Adutwum Mmborosa, said the Plaintiff was a limited liability company registered and specialises in the repair and servicing of fuel injection pumps.

It said between November 24, 2003, and February 25, 2004, the defendant sent quantities of fuel injection pumps for repairs and servicing at a cost of 42.2 million cedis.

The statement said total value of work done on the injectors for and on behalf of the defendant was 42.2 million cedis, out of which he had so far paid only four million cedis.

It said despite repeated demands the defendant had refused or failed to settle his indebtedness.

The statement therefore prayed the court to help enable the plaintiff recover the said amount with interest.

In a statement of defence, the defendant denied the plaintiff’s claim and said he sent the pumps to the plaintiff for repairs only as Agent of the Sain Goldfields Limited and never agreed with the plaintiff that he the defendant would bear the cost of repairs. The defence was entered on behalf of the defendant by his solicitors, Messrs D.M. Adusei and Co.

The statement said whatever the defendant did, including the signing of documents for the repairs was done for and behalf of Sain Goldfields Limited and that he is not personally liable to the claims of the plaintiff.
