GHc1.3m gold scam: Basintale, others sue Police Service

Interdicted police capo DSP Emmanuel Basintale and four others have sued the Ghana Police Service for violating their rights.

The five officers who have been accused by an American company, Green Global Resources, in an alleged gold scam were interdicted in March this year, accused of conspiring to steal 13 gold bars and replacing them with fake ones.

The lawyer for the accused Kissi Agyabeng argued that the Police has no case against the officers and called for their reinstatement.
He said: “There are two aspects of this matter as stated from the opening paragraph, one is to publicly refuse this allegations and two, to seek legal redress. For the police department is clearly unwilling to abide by its own regulations as stipulated by law.”

“When I asked them when the service enquiry was supposedly constituted and when my clients were notified way back 30th May, 2017; they have been unable to answer these simple questions,” Agyabeng stated.
Following the refusal of the Police to reinstate the interdicted cops they have sued the Police administration seeking four reliefs.
“Following the expiration of the three month after the interdiction of the applicants without the institution of disciplinary proceedings against them, the first respondent is mandatorily required to revoke their interdiction and reinstate them to resume duty as per regulation 105/12 of the Police Service Regulations.

“The first respondent does not have the legal authority to extend the statutory prescribed three-month period within which to institute disciplinary proceedings against the applicants and a clear attempt by the first respondent to do so it amounts to abuse of office and an unlawful act.
“The disciplinary committee constituted by the first and second respondents after the expiration of the statutorily prescribed three-month period within which to institute disciplinary proceedings against the applicants is null and void,” Agyabeng indicated.

Meanwhile, the Police Service has confirmed receiving the writ.
