Akim Oda, May 13, GNA – Justice E, B. K. Agbloyor, the Akim Oda High Court Judge on Friday said the law allows the police to enter any premises and carry out searches with or without a warrant. Mr. Justice Agbloyor was giving a ruling on a motion on notice filed by Nana Ahenkora Dwadon, II, the Ahenenanahene of the Akyem Bosome traditional area praying the court to compel the Omanhene of the Traditional Area to allow the police to inspect the state regalia in the stool room of the traditional area.
In his affidavit, Nana Dwadon said he had information that certain items had been stolen from the stool room of the traditional area and lodged a complaint to the police to conduct a search to determine the truth of otherwise of the information.
The plaintiff contended that all attempts by the police to get the defendant to open the store room for a search to be conducted by the police had failed.
Justice Agbloyer said he was not acting in a manner to force the Omanhene and the Traditional council to perform any public or legal duty imposed on them by law, but only to allow the police to do their work. He therefore, advised the counsel of the traditional council that it was in their best interest to allow the police to carry out their statutory duties of investigating an alleged theft of stool regalia.
