The Supreme court will today deliver its verdict in a writ filed by the Ghana Bar Association(GBA) and two others challenging the President’s power of appointing Superior justices without the advise of the Judicial Council.
The Ghana Bar Association (GBA) sued the Attorney General And Minister of Justice together with the Judicial Council over the appointments of Supreme Court judges, Justices Yaw Apau and Gabriel Pwamang.
The two Supreme Court justices were sworn-in by the President at the Flagstaff House after the Appointment Committee of parliament approved their nomination.
But the GBA led by its President Nene Amegatcher filed a suit seeking to nullify the appointment of Justice Yaw Apau and Gabriel Pwamang as Justices of the apex court.
The GBA has prayed the court to declare that upon true and proper construction of Article 144(2,3) of the constitution all appointments made by the President of the Republic of Ghana are valid until they’re made in strict accordance of the advise of the Judicial Council.
Their case has been consolidated by two other applicants- Richard Dela Sky and Kwasi Danso Acheampong who have jointly filed a separate case seeking an interpretation of Article 70 on whether or not the President must act in accordance with the advise of the Council of State in some appointments.
