The Office of the Special Prosecutor (OSP) has revealed plans to bring eight individuals including former Finance Minister Ken Ofori-Atta before the court on Monday, November 24, over matters linked to the Strategic Mobilisation Limited (SML) issue.
This move comes after prosecutors filed 78 charges against Ofori-Atta and seven additional accused persons. The charges relate to their alleged roles in the disputed revenue assurance agreements between the Ghana Revenue Authority (GRA) and Strategic Mobilisation Ghana Limited (SML).
According to an update shared on the OSP’s official Facebook page, the office will also request orders from the court to allow service of the charge sheet on suspects who are currently outside Ghana’s jurisdiction.
The former minister and the others are facing 78 accusations involving corruption and offences connected to corruption, including “conspiracy to commit the criminal offence of directly or indirectly influencing the procurement process to obtain an unfair advantage in the award of a contract.”
The OSP explained that these charges filed on Tuesday, November 18, 2025 represent breaches of section 23(1) of the Criminal Offences Act, 1960 (Act 29), as well as section 92(2)(b) of the Public Procurement Act, 2003 (Act 663).
A section of the suit, lodged at the Criminal Division of the Accra High Court under case number CR/0106/2026, states:
“Conspiracy to commit the criminal offence of directly or indirectly influencing the procurement process to obtain an unfair advantage in the award of a procurement contract, contrary to section 23(1) of the Criminal Offences Act, 1960 (Act 29), and section 92(2)(b) of the Public Procurement Act, 2003 (Act 663).”
