Seizure of Argentine Warship was wrong – Supreme court

The Supreme Court has ruled that the High Court which ordered the seizure of Argentine military asset was wrong.

The ruling also stated that the order from the High Court could endanger Ghana’s security and risking a potential military conflict or diplomatic conflict.

The Attorney-General had applied for certiorari to quash order of the High Court allowing the attachment of the naval vessel in enforcement of a commercial contract.

SC settles Ghanaian law on the issue on public policy grounds and directs that military assets should never be seized even if there is a waiver of sovereign immunity by states as was the case in this case.
