Residents file writ against KMA

TWO residents of Kumasi, Messrs Francis Adjei Mensah and Kwabena Amofa-Sarpong , have jointly filed a writ of injunction at a Kumasi High Court to restrain the Kumasi Metropolitan Assembly from holding any meeting pending the interpretation of Section Four of the Standing Orders of the Metropolitan Assembly.

An affidavit filed for the two, on behalf of their counsel, Mr A.K. Amankwaah, in support of the motion, noted that any meeting conducted by the assembly would be contrary to the standing orders of the assembly.

It said such a meeting would be unlawful and illegal and its outcome could cause irreparable damage.

The standing orders of the assembly require that the convening of a meeting, which could be done by one-third of the members, be calculated from the date the notice is issued or from the time of receipt of summons to the meeting. It pointed out that? no damage will be caused to the defendants if the application for interim injunction is granted?.

However, in spite of the court injunction, the Presiding Member of the assembly, Nana Nsiah Awuah, was convening the meeting at the time of going to press.

Nana Awuah said even though he had been served with copies of the injunction, it was only an application and did not in any way restrain the assembly from conducting any meeting.

He was in the process of contacting the acting co-ordinating director to take minutes of the meeting, stressing that the meeting will go on if the assembly fails to locate him.

Nana Awuah said he was also contacting the Metropolitan Chief Executive , Mr Maxwell Kofi Jumah, about the meeting.

A reliable source told the Graphic that the intended meeting is to enable the members to pass a resolution of no confidence in the Kumasi mayor. It alleged that the mayor is not performing to the satisfaction of members of the assembly and, therefore, they want to kick him out of office before the dissolution of the assembly in two weeks? time.
