Human rights activists to serve hearing notice on FDA

A Human Rights Court in Accra on Wednesday adjourned to June 1, 2015 the suit against Fan Milk Limited over alleged sale of expired products on the market.

The adjournment is to enable the plaintiff to serve a hearing notice on the Food and Drugs Authority (FDA), the second defendant in the case.

It is also because the second defendant was absent from court at the last adjourned date.

The case was filed by Mr Jonathan Osei-Owusu, a human rights activist and the Chief Executive Director of The Perfector of Sentiments Foundation (POS), an NGO.

The POS Foundation and Mr Osei-Owusu sued Fan Milk Limited and the FDA over the sale of expired food products on the market.

The suit follows a severe stomach ache; Mr Osei-Owusu said he suffered after eating a Fanyogo product; he purchased in August, 2009, from one of the company’s vendors.

The plaintiff is asking the court to order the company to fix an expiry date on Fanyogo, one of its products, and make it legible and to also institute an effective monitoring mechanism to protect public interest and safety.

According to the plaintiff the company should also stop the sale of its products in the sun.

He is praying the court to place an injunction on the company’s production, especially Fanyogo, until they had met the conditions and recalled the product on the market.

Additionally, POS Foundation is seeking an extensive health care in favour of Mr Osei-Owusu as well as general damages and cost.
