High Court reverses Hassan Ayariga’s disqualification

An Accra High Court has ruled in favour of flagbearer of the All People’s Congress, Hassan Ayariga in a case where the APC flag bearer is challenging his disqualification from this year’s presidential elections.

According to the court ruling, the Electoral Commission should grant Hassan Ayariga the opportunity to amend errors with his nomination forms within a stipulated period.

According to the court, the EC acted unreasonably by disqualifying the APC flag bearer without giving him the opportunity to rectify errors identified on his forms.

Hassan Ayariga and 12 others were disqualified from contesting in the presidential elections in December for failing to meet set criteria in CI 94. According to the Electoral Commission, a number of errors on the APC flag bearer’s nomination forms meant he had failed to meet the provisions in the Constitutional Instrument hence his disqualification.
