“He Should Resign” – Martin Kpebu Slams Kissi Agyebeng Over Handling of Ofori-Atta’s Case

Private legal practitioner Martin Kpebu is demanding the immediate resignation of Special Prosecutor Kissi Agyebeng, arguing that recent revelations in the Ken Ofori-Atta matter amount to a breach of duty and a loss of public confidence.

Speaking on Joy News’ PM Express, Kpebu clarified that although he had been invited by the Office of the Special Prosecutor (OSP), he was not under investigation, but was only asked to explain comments he had made—remarks he maintains were intended to strengthen the national fight against corruption.

He outlined several concerns, describing the most serious as grounds for the Special Prosecutor to resign. According to him, the OSP “finally admitted on November 5” that before former Finance Minister Ken Ofori-Atta travelled out of Ghana, Kissi Agyebeng intercepted a letter Mr Ofori-Atta had written to both the incoming and outgoing Chiefs of Staff.

Kpebu said the Special Prosecutor confirmed intercepting the document and then urgently seeking assistance from multiple security agencies.
“He said he intercepted the letter, then ran to the National Investigations Bureau (NIB) but got no help, moved to National Security and still got no help, and finally went to the Ghana Immigration Service without success,” he recounted.

While he described the situation as a significant indictment of the security agencies, he stressed that the larger failure was the OSP’s decision not to alert the public.

He argued that the Special Prosecutor, who had previously held what he termed an “Ankwanuma” press conference, should have called a briefing to inform citizens that he had evidence the former minister was preparing to travel and that the security bodies were not cooperating.
“Imagine how many people would have taken steps to the airport to stop him from leaving,” he said.

Kpebu added that at the time, he served with the ORAL team, which he said had influential security figures such as Kofi Boakye capable of responding swiftly if they had been informed.

For him, this failure to raise an alarm and act decisively is enough justification for Kissi Agyebeng to resign.
