A Former Governor of Bank of Ghana (Bog), S.K. Appiah, and three others who have been subpoenaed by an Accra Commercial Court to help uncover the mystery surrounding a $2.5billion loan package for Ghana are expected in court today, Tuesday, October 27, 2009.
The court, which is hearing a case between Mr. Van Kirksey and Associates, as plaintiff, and Egbert Adjeso and P.V. Obeng as well as the Bank of Ghana as the defendants, wants the four persons to assist the court to locate the whereabouts of the said loan.
Mr. Van Kirksey, the chairman of the U.S Company who initiated the court action against the defendants, is seeking redress to retrieve his 10 per cent share agreement of the total loan package he used his company to acquire for the country. Mr. Appiah is to appear with S.N. Adjei, then counsel for Bank of Ghana, Dr. KG Erbyn, then Chief Executive of Ghana Investment Centre and Mr. Aduamoa Bossman, former attorney for Van Kirksey.
The loan is said to have been introduced to the Government by Van Kirksey and Associates International of Washington, an African America company, somewhere in 1986. According to facts, Mr. Appiah, then acting as BoG Governor, allegedly signed and sealed the mandate for the loan to be brought into the country. Although the subpoena was issued somewhere in June 2009, none of the personalities involved have been in court.
The court, presided over by Justice Margaret Insaidoo, on July 15 2009 had warned counsel for Egbert Adjeso on whose appeal the subpoena was issued to make sure the witnesses appeared before it or pays costs for delaying proceedings.
