Election Petition: Mahama, NDC file affidavits

Lawyers for President John Mahama as well as the National Democratic Congress (NDC) have reportedly filed their affidavits at the Supreme Court in readiness for the substantive hearing of the election petition which begins tomorrow.

A member of the legal team of the NDC Victor Kojogah Adawudu told Myjoyonline.com on Monday afternoon that “we are presently at the court filling the affidavits”.

We are filing for the president and that of the NDC, he added.

The two respondents had five days upon service of the petitioners’ affidavits to respond and Adawudu is convinced they are well on track to meeting the directive by the court.

He is however unsure if full scale hearing will begin tomorrow since the petitioners have to be served with the copies of the respondents affidavits.

It is however unclear if the second respondent, which is the Electoral Commission has also responded to the affidavits filed by the petitioners.

The EC had initially sought to ask the court to vary its own ground rules in order for them to file their own affidavits only after the petitioners had presented their case before the court but the Supreme Court judges overwhelmingly threw out the request and directed the EC to file their affidavits five days after the petitioners have filed their own affidavits.

The court sits tomorrow April 16, 2012.
