CPP Congress Illegal – NYO

MEMO
FROM : MURTALA MOHAMMED (NYO)
TO : HON. BAWUAH K (CHAIRMAN OF COUNCIL OF ELDERS)
CC : COUNCIL OF ELDERS
DATE : 07/05/2012
SUBJECT: ILLEGAL CONGRESS
Albeit this letter will be regarded as contumacious by a section of your membership, I will go forth; taking solace in Article 8 of our party’s constitution which state and I quote “Subject to the provisions of the constitution of the Republic of Ghana, and any laws for the time being in force in the Republic, the provision of this constitution shall take precedence over and above any and all other rules and regulations of the party”.
I wish to bring to your notice that the upcoming CPP congress to be held on May 12, 2012 is bogus, fraudulent and unconstitutional due to the violation of the following constitutional provisions;
1. Article 22
2. Article 70 Clauses (2) (3) (5) (6) (7).
3. Article 78 Clause (3)
4. Article 95(C)
5. Article 102(i-v)
6. Article 103 Clause (4)
If you could remember, in November last year, I wrote a petition to you in which I raised pertinent issue with regard to the leadership of this great party and predicted a disintegration if you did not intervene. I know you are already aware of the massive breakaway of some members of our party especially to the newly formed PPP of Dr. Papa Kwesi Nduom.
I foreshadow that, the various constitutional provisions that has flouted by the leadership of the party will bring about a lot of litigation unto the party. A phenomenon the party is not ready to absorb especially during election year.
Contrary to the rumours and tittle-tattle that is making the round about my supposed resignation, I wish to inform you that, I am a true Comrade and Nkrumahist whose loyalty and commitment to the party is unshaken. The above assertions should therefore be taken seriously as may hinder the progress of the party as we embark on making an impression in 2012 election.
Thank you
Murtala Mohammed
