Court sets aside own order for interim injunction

Accra (Greater Accra), 3 Mar, ’99 –

A High Court in Accra has set aside its own order for interim injunction against the Atlantic Port Services (APS) made on November 16, last year, restraining one of its directors, Mr Geoffrey Kojo Adebayo Biney, from exercising any executive function in the APS. The order to set aside the interim injunction was made upon hearing a motion on notice, filed on December 21, 1998 by APS and Mr Adebayo Biney who were dissatisfied by the court’s earlier decision. The court presided over by Mrs V. S. Sawyerr-Williams, said upon hearing counsel for both sides in the case, “it is hereby ordered that the order for interim injunction granted on November 16, 1998, is hereby set aside”. In November, last year, four persons, Mr Erzuah Kweku Biney, alias William Hamilton Biney, Mamie Ekuah Amanyinwah Biney, Efua Gbemisol Biney and Cephas Ekow Biney, all of Osu, filed an ex-parte motion asking the court to restrain Mr Adebayo Biney from exercising any executive function in the APS. The plaintiffs asked the court to give an order, to stop him from appending his signature to bank accounts of APS until the final determination of a suit pending before the court. Mr Adebayo Biney and APS, who were dissatisfied with the injunction order, filed a motion on notice praying that the court should set aside its earlier order. Mr C. B. K Zwennes is counsel for APS and Mr Adebayo Biney while the four plaintiffs, were represented by Mr Amarkai Amarteifio.
