The Human Rights Division of the High Court in Accra has ordered suspended Chief Justice Gertrude Sackey Torkornoo to serve her affidavit in opposition against the Attorney General’s application to strike out her action and proof service.
The court observed that there was no proof of service of her affidavit in opposition against the AG’s request on record. “There is no proof of service of the (suspended Chief Justice’s) affidavit in opposition to the Respondents/Applicants’ motion for an order to strike out filed on July 11, 2025,” the court said. “Let the said affidavit in opposition be served and service thereof duly proved,” the court added.
The case has been adjourned to July 23, 2025, after the Attorney General’s office requested an adjournment due to the AG and his deputy’s unavailability.
“I have the express instructions of the Honorable Attorney General to seek an adjournment of this matter to next week,” State Attorney Reginald Nii Odoi said.
Counsel for the suspended Chief Justice, Kwabena Adu Kusi, urged for expedited hearing due to public interest.
“By the nature of the proceedings and the public interest attendance to it, we require some speed,” he said.
The suspended Chief Justice had filed an application for judicial review alleging human rights violations following her suspension. The Attorney General had filed a counter-action to strike out her application, citing that the same matter is pending before the Supreme Court.
