Court of Appeal dismisses NDC’s stay of proceedings

The Court of Appeal has dismissed a motion for stay of proceedings pending appeal filled by the National Democratic Congress and Mr Fiifi Kwetey, the Member of Parliament for Ketu South.

The court also awarded GH¢100,000.00 cost against the applicants. The court held that the arguments raised by the applicants did not meet the basic consideration for stay of proceedings, which would make them suffer injustice if the trial was not stayed.

Mr Kwetey who is also the Minister of Transport and holding himself as the incumbent parliamentary candidate of the National Democratic Congress (NDC) for the constituency is appealing against the High Court’s dismissal of an application challenging the capacity of a suit filed against them by mr Albert Zigah also a member of the NDC.

Mr Zigah, a disqualified contestant in the parties primaries in the Ketu South constituency had sued the NDC and mr Kwetey over his disqualification which he described as unlawful.

He is accordingly praying the court to declare it null and void and also restrain Mr Kwetey from holding himself as parliamentary candidate for the constituency.

However, the two have argued that the suit against them is misconceived and should be dismissed.

The court however declined and ordered them to file their written submissions. Mr Kwetey and the NDC also contend that, the High Court, erred in its ruling, and are therefore praying the court of Appeal to set aside the ruling and strike out the pleadings of Mr Zigah for abusing the court process.
