Court frees farmer from defilement case

A Tarkwa Circuit Court has acquitted and discharged a 19 year-old farmer, Nashiru Mumuni who was charged for defiling a 13-year-old girl at Nyame Nea near Asankrangwa in the Western Region.

Mr Samuel Obeng Diawuo, the Judge said the complainant has refused to appear before the court for the case to be heard.

He said the court cannot continue to keep the accused in remand as he had already spent four months in police custody.

Prosecuting Deputy Superintendent of Police (DSP), Albert Adiita, earlier on told the court that the complainant Joseph Danquah, a farmer and father to the victim lived at a cottage near Nyame Nae in the same vicinity with the accused.

He said on October, 2011 the victim went to school and while she was playing with her colleagues during break, the accused gave her money to buy kenkey for him.

According to the Prosecutor, when the victim went to the accused house to give him the food, he lured the victim into his room and forcefully had sexual intercourse with her.

DSP Adiita said a month later the victim’s teacher detected that she was pregnant and when she was questioned, the victim mentioned the accused as the one responsible.

He said the teacher then informed the complainant who confronted the accused with the issue and he admitted the offense.

The prosecutor said on January 19, the complainant was arrested and arraigned.**
