Court adjourns Fan Milk’s case

Accra, July 11, GNA – A human rights court in Accra on Monday adjourned a case filed against Fan Milk Limited over expired products sold on the market to October 25 for hearing. The case was filed by Mr Jonathan Osei-Owusu, a human rights activist and the Chief Executive Director of Pos Foundation, an NGO. Pos Foundation and Mr Osei-Owusu have sued Fan Milk Limited and the Food and Drugs Board over the sale of expired food products on the market.

At Monday’s sitting both counsel were absent and so the presiding judge, Mr Justice U. P. Dery, adjourned the case to October 25. The suit follows a severe stomach ache Mr Osei-Owusu said he suffered after eating a Fanyogo product he purchased in August, 2009 from one of the company’s vendors. The plaintiff is asking the court to order the company to fix an expiry date on Fanyogo, one of its products, and make it legible. The company should also stop the sale of its products in the sun by vendors.

The plaintiff is asking the court to order the Food and Drugs Board to ensure that Fan Milk fixes legible expiry dates on the products and institutes an effective monitoring mechanism to ensure public interest and safety. Furthermore, Pos Foundation is seeking an extensive health care in favour of Mr Osei-Owusu as well as general damages and cost. 11 July 11
