Ashitey withdraws SC review case

Member of Parliament for Klottey Korle constituency Nii Armah Ashitey has withdrawn his application for a review of the ruling of the Supreme Court which said High Court Judge Justice Ackah Boafo lacked jurisdiction to sit on a case in which the MP challenged the eligibility of Dr Zanetor Agyeman-Rawlings as the elected parliamentary candidate for the constituency in the governing National Democratic Congress’ primaries late last year.

Lawyer for the MP, Gary Nimako Marfo, was forced to withdraw the motion because he failed to convince the Supreme Court to reconsider their ruling, reported Class91.3FM’s court reporter Nabil Ahmed Rufai Wednesday June 15.

The Supreme Court on 19 May quashed the mandate of High Court Judge Justice Ackah Boafo to sit on the case.

Mr Godwin Tameklo, lawyer for Dr Agyeman-Rawlings, told the media Wednesday June 15 that: “He [Gary Nimako] was not forced [to withdraw the application but] the motion for review was dead on arrival. He knew it”.

“He has wasted everybody’s …time and he should stop that kind of practice …As you are aware already, it’s out of time for him to file his address to the court, but we want an expeditious trial, we are not going to wait for him.

“At all material times, he knew that the path that he had taken would waste the court’s time and today in his speech you saw how embarrassing it was, how embarrassing…to withdraw his application. It’s so regrettable that we have to go by it. I am in pain as to the attitude that he has taken …he has wasted everybody’s time.”
