CHRAJ Director warns public to respect the property rights of spouses

Tepa (Ash), March 7, GNA – Mr Godfred Owusu, Ahafo-Ano North District Director of Commission on Human Rights and Administrative Justice (CHRAJ), has cautioned the public to respect the property rights of surviving a spouse and children when one of them dies.

He reiterated that the laws of this country especially the 1992 Constitution and the Intestate Succession Law (PNDCL 111 of 1985) adequately protect surviving spouses and children of deceased persons from being deprived of a reasonable provision out of the estate of their lost one whether or not the deceased died without having made a Will. Mr Owusu said this when he amicably settled misunderstanding between the spouse and family members of the late Peter Ansere of Manfo near Tepa last Monday over the property of the deceased who died on January 19, this year.

He explained that under the Intestate Succession Law, the spouse and the children are entitled absolutely to the household chattels of the estate and at the same time have a reasonable share of the rest of the deceased property.

He said it was wrong and unlawful for relatives of the late Peter Ansere to forcibly eject the widow from the house she was staying with her husband and lock their provision store soon after the death of the man.
