Kpandai MP Challenges High Court Ruling That Annulled His Election Victory at Supreme Court 

The Member of Parliament for Kpandai, Mathew Nyindam, has filed an application at the Supreme Court seeking to overturn the decision of the High Court, Commercial Division in Tamale, which voided his 2024 parliamentary election victory.

Nyindam, represented by his lawyer Gary Nimako Marfo, argues that the High Court acted outside its legal authority when it entertained an election petition filed by NDC candidate Daniel Nsala Wakpal. He maintains that the petition was filed out of time and therefore could not lawfully trigger the court’s jurisdiction.

The challenge stems from a petition submitted on January 25, 2025 — thirty-two days after the election results were gazetted on December 24, 2024. Under Section 18 of the Representation of the People Law, 1992 (P.N.D.C.L. 284), such petitions must be filed within 21 days. Nyindam contends that this lapse invalidated the entire petition.

According to his affidavit before the Supreme Court, “The Parliamentary Election Petition filed by the 1st Interested Party on 25th January 2025… was invalid and could not have properly invoked the jurisdiction of the High Court, Commercial Division, Tamale.”

The High Court’s ruling on November 24, 2025, annulled the Kpandai parliamentary results and ordered a fresh election within 30 days. Nyindam is now asking the Supreme Court to issue a certiorari to quash that judgment and all related proceedings on the grounds that they were based on a petition filed outside the legally permitted timeframe.

The Supreme Court is scheduled to hear the application on Tuesday, December 16, 2025. Nyindam’s legal team says the matter raises a critical jurisdictional issue, warning that allowing the High Court decision to stand would undermine established statutory rules governing election dispute timelines.

In the December 7, 2024 polls, Nyindam, representing the New Patriotic Party, was declared winner with 27,947 votes (53.47%), while the NDC’s Wakpal secured 24,213 votes (46.33%).
