The Office of the Attorney-General has filed to strike out a second judicial review application brought by suspended Chief Justice Gertrude Torkornoo, who is seeking to invalidate one of three removal petitions pending against her.
The fresh application, lodged on June 23, 2025, contests a petition submitted by a group calling itself the Shining Stars of Ghana. Lawyers for the suspended Chief Justice argue that the petition is defective since the group is not registered and its membership is unclear.
But in an affidavit sworn by State Attorney Reginald Nii Odoi, the Attorney-General’s office countered that under the law, a body of persons—whether registered or not—can still be recognised and does not require incorporation to exist legally.

This is Justice Torkornoo’s second attempt to rely on the High Court’s review powers to stop the Article 146 proceedings. Her earlier effort, which sought to strike out all three petitions and suspend the Justice Pwamang Committee’s hearings on grounds of procedural unfairness, was dismissed as an abuse of process and outside the court’s jurisdiction.
Although a related interpretation case remains before the Supreme Court, her application for an injunction was refused, allowing the removal proceedings to continue.
The Attorney-General’s office, in its latest response, insists that Justice Torkornoo’s objections relate to the internal work of the Article 146 committee—proceedings which the Constitution requires to be held in camera. It concluded that the issues raised “are not admissible” before the High Court, maintaining that the court has no jurisdiction over matters arising under Article 146.
