The Court of Appeal presided over by Justice F.G Kobieh has set Wednesday, July 26 to rule on Francis Xavier Sosu’s application of stay of execution of suspension by the General Legal Council.
The application is to stop the council from enforcing its decision to suspend the famed human rights lawyer from practising for 3 years.
Mr Sosu was suspended by the Legal Council for grave misconduct and overestimation.
According to Counsel for Mr Sosu, the Legal Profession Act, 1960 does not define ‘grave misconduct’ and as such one cannot be charged with the offence.
He added that according to the Act, the penalty for overestimation is a fine and not a suspension as the council has done.
Counsel for the General Legal Council, Kizito Beyuo asked the court to dismiss the application as it does not have “jurisdiction to entertain the application”.
He added that there is no valid notice of appeal so the court was not under obligation to sit on the issue.
Mr Xavier-Sosu will file a full application against his suspension if the court ruling on 26th July goes in his favour.
