The Agona Swedru High Court on Wednesday dismissed an application for interlocutory injunction filed by Mr Adolf Mfodwo, restraining the New Patriotic Party (NPP) and the Electoral Commission (EC) from fixing a date to re-run the parliamentary primary in the Gomoa East Constituency.
Mr Mfodwo, the plaintiff, and several thousand members of the NPP, felt extremely aggrieved that Mr Marcus Yaw Danso ‘is being shot-changed with a nasty raw deal”.
The court presided over by Mr Justice Peter Dei Ofei, said the application was unmeritorious and misconceived, and accordingly dismissed it.
Mr Mfodwo claimed that Mr Danso had 154 votes against Mr Kojo Asomani who obtained 153 votes during the parliamentary primary held on June 13 at Gomoa Akramang.
The plaintiff prayed the court to stop the EC, and the NPP from conducting the re-run to elect a parliamentary candidate.
According to him, Mr Danso should be declared winner because one of the ballots was not counted.
The court said the first count and the re-count were done in the presence of the candidates’ agents, the police and some constituency executives of the party, as well as some supporters of the candidates.
According to the court, there was nothing before it to prove to the contrary that in fact the rejected vote was indeed “valid”.
“In this circumstance, the application for interlocutory injunction is unmeritorious and misconceived and same is dismissed,” the court ruled.
