Hotel brings action against Multichoice

Longford Royal Hospitality Services Limited, owners of Longford hotel at Duase in Kumasi, have filed a suit at a Kumasi High Court against Multichoice Company Limited, operators of DStv for breach of contract.

The plaintiffs are claiming general damages for unilateral and illegal disconnection of DStv services to the hotel rooms, resulting in the loss of clients and revenue totaling over GH¢48,600.

They are also seeking general damages against an employee of the company, Tsatsu Kudiabor, for trespassing, and a declaration that the unilateral disconnection of services without reference, notice and basis, is unlawful and a breach of contract.

In their statement of claim, they stated that the second defendant went to the premises of the hotel on Sunday, November 2, at about 1230 hours and without any notice or tag of accreditation, to undertake inspection of DStv facilities in the rooms of the facility.

The attendants unable to ascertain his identity refused him entry.

There were some guests in the rooms, and again the company did not notify management of the hotel, as had always been the case.

The statement said the second defendant realizing that the staff would not allow him entry, made a call to the offices of the company to disconnect the DStv services.

The plaintiffs maintained that they had credit balance of about GH¢700 on their account at that time, which did not warrant the disconnection and that the company’s action breached the purchase agreement between them.
