A Kumasi businessman, Mr. Kofi Nimoh, has petitioned the Attorney General and Minister of Justice to prevail upon the Ashanti Regional Tribunal to deliver judgement in an appeal case before it.
Judgement in the said case had originally been fixed for October 13, last year , but to date the court’s ruling and judgement has not been delivered.
The complainant fears that should the tribunal system be abolished as being advocated the case would die out.
The case, which proceedings ended in June, last year, was filed by Nana Sarfo Ababio, chief of Kotei, near Kumasi.
According to Nimoh, he purchased a piece of land in 1995 from the Kotei Plot Allocation Committee, headed by the chief.
He said when the house had been developed to the lintel level it was pulled down by one WO I Yaw Akoto, who claimed to have bought the same piece of land from the chief.
The chief’s conduct was reported to the police who arrested and charged him with conflicting grants, fraud, false pretence and conspiracy to cause damage.
Nana Sarfo was found guilty of the charges and fined ?1 million, which he paid.
He further appealed against the trial circuit tribunal’s verdict.
The appeal, according to Nimoh, commenced in April 1997, at the Ashanti Regional Tribunal, presided over by Mr. Kwesi Aggrey, now on transfer to Cape Coast.
The case was duly determined over three years, but Nimoh is worried over the delay in the delivery of the judgement.
He fears the transfer of his Lordship Kwesi Aggrey to Cape Coast might further delay the judgement, in which case the chief would engage in the sale of the land without restraint.
